Your privacy is important to TIRESEASY, LLC. (“Client”, “we”, “us”). This privacy policy (“Policy”) applies to www.tires-easy-truck.com (the “Site”) and tells you how personal information is collected, used, disclosed, and protected by us. The Site and our offline collection are collectively referred to as the “Services”. This Policy applies to our current information collection, use, and disclosure practices. By using the Services you consent that we may process the data that we collect from you in accordance with this Privacy Policy.

We will regularly review this Privacy Policy and may change this Policy from time to time. If we make any changes to this Policy, we will change the “last updated” date above. If there are material changes to this Policy and you have an active account with us, we will notify you directly. We encourage you to check this Policy whenever you use any of Services to understand how your personal information is used.

2. Children’s Privacy

Our Site is not intended for children under 18 years of age. No one under the age of 18 may provide any personal information to the Site. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on the Site. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. We collect information from you in various ways when you use our Services. We may also supplement this information with information we receive from other companies, including our affiliates. It does not include publicly available data, de-identified data, or aggregate information that cannot be reasonably linked to you.

Information You Give Us. We collect information you give us on our Site, and when you register for and use our Services. Examples include the following:

• Registration and Profile Information. When you register to use our Services or update your profile, we may collect various kinds of information about you including, your name, cell phone number and email address; other profile information you provide; demographic information; and information you upload like photos, files, and documents.
• Contact Information. We may collect the email addresses and cell phone numbers you provide for contacts you enter or upload into your address book.
• Payment Information. If you choose to purchase a product or service, our payment processing vendor collects your credit card information and billing address.

Automatically Collected Information. We automatically receive certain types of information when you interact with our Services through your computer, phone, or other web-connected device (“Device”). That information includes your Device’s IP address, access times, your browser type and language, geolocation, and referring web site addresses. No personal information will be used to contact you by text without your consent except to respond to a text inquiry from you or, if you provided a valid cell phone number, to provide confirmation and other information (e.g. delivery, status updates, scheduling, etc.) related to a transaction or an order placed by you.

5. Sharing of Personal Information

We will not share any of your personal information with any third party except as outlined in this Policy or with your consent. We may disclose the following information to a third party for the following purposes:

Your personal information may be disclosed to:

• Third party service providers that assist us with fulfilling orders, managing customer records, and marketing our products and services. We ask that all third-party service providers use the information provided only for the purpose it is provided, and to protect your information with policies and procedures that are in line with this Privacy Policy;
• Talkdesk and Zendesk, which administers our website chatbot and provides customer service support;
• Shopper Approved, which collects customer reviews on our behalf;
• Business partners who provide services related to our products including financing partners, distribution partners, installation partners, and warranty partners;
• Law enforcement or other governmental entities:
  • to comply with laws or respond to lawful requests and legal process;
  • to protect us, as well as our agents, customers, and others, including to enforce our agreements, policies and terms of use;
  • in the good faith belief that disclosure is needed to respond to an emergency, or protect the personal safety of any person;
• Another company in connection with an acquisition, merger, or sale of all or a substantial portion of our business, with or to that company. In such an event, you will receive notice if your data is transferred and becomes subject to a substantially different privacy policy;
• Payment Information will be disclosed to our payment processing vendor to process your payment for a product or service; and
• Device and activity information will be disclosed to third party analytics providers and advertising networks with whom we contract for analytics and advertising services.

We may share Aggregate Data about our customers, sales, and traffic to our partners and advertisers. We share Aggregate Data to help us better understand our customer needs and improve our Services, to provide new Services, and for advertising and marketing purposes.

6. Network and Information Security

We take reasonable steps to protect information we collect from you to prevent loss, misuse and unauthorized access, disclosure, alteration, and destruction. In addition, highly confidential personal information such as credit card number and password that we request from you on our Site is protected with encryption, such as Secured Socket Layer (SSL) protocol, during transmission over the Internet.

The servers on which information is stored are kept in a controlled environment with limited access. While we take reasonable efforts to guard personal information we knowingly collect directly from you, no security system is impenetrable.

Your account information is accessible only through the use of an individual user ID and password. To protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person. Please advise us immediately if you believe your password has been misused. In addition, always log out and close your browser when you finish your session. Please note that we will never ask you to disclose your password in an unsolicited phone call or email.

7. Updating and Accessing Personal Information

If your personal information changes in any way, you must correct or update your information as soon as possible. You can make updates to your profile information by logging into your account at any time. You can also request changes or access to your information by emailing info@tires-easy-truck.com.

Accounts on this site can be anonymized or deleted at the user’s request. Contact the administrator legal@tires-easy-truck.com, for details. Please note, account deletion will lead to the deletion of all personal data and it cannot be recovered.

8. Membership Program

We run a bona fide loyalty program that gives consumers who provide certain personal information member discounts and rewards on the website. We collect your email address to run the program. We do not sell or share the personal information you provide for this program with any third parties, other than our service providers.

9. Your Rights and Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We do not respond to Do-Not-Track signals at this time; however, the following mechanisms provide you with certain control over your information:

• Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this Site may then be inaccessible or not function properly.

We use AB Tasty and Blue Triangle for site analytics and site improvement purposes. AB Tasty collects information on your interaction with the Site including the pages you view and the buttons you click, as well as your device type, browser, IP address, and geolocation.

We use Facebook Connect to enable connections to our Facebook page and for analytics purposes. Facebook Connect collects information on your interaction with the site including the pages you view and the buttons you click, as well as your device type, browser, IP address, and geolocation. Facebook may use this information for personalization of ads, and your activity may be tracked over time and across websites. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website. This California Resident Privacy Notice section supplements the information contained in the Privacy Policy and applies solely to all visitors, users, and others residing in the State of California.

Your Rights and Choices

California residents have specific rights regarding their personal information. This section describes those rights.

Right to Limit Use and Disclosure of Sensitive Personal Information

We do not collect or process sensitive personal information for the purpose of inferring characteristics about consumers. We also do not disclose sensitive personal information for purposes other than those specified in section 7027(m) of the CCPA regulations promulgated by the California Privacy Protection Agency. Therefore, we do not offer consumers the option to limit the use of their sensitive personal information.

Right to Opt Out of Sharing for Cross-Context Behavioral Advertising

In the past twelve months, we have used data about your activities on our online properties to serve you ads on online properties owned or controlled by third parties. In the past twelve months, we have provided the following categories of information to advertising partners and data analytics providers for this purpose:

• Personal identifiers, such as unique personal identifier, online identifier, internet protocol address, device information and identifiers, and unique advertising identifiers and cookies; Internet and other electronic network activity information; geolocation information; inference data; and commercial information.

California residents have the right to opt out of the sharing of their personal information for cross-context behavioral advertising purposes. Right to Opt Out of Sale

While we do not sell personal information in exchange for monetary consideration, we do share personal information for other benefits that could be deemed a “sale”, as defined by the CCPA. The CCPA broadly defines “sale” in a way that may include activities such as the delivery of targeted advertising on websites or allowing third parties to receive certain information, such as cookies, IP address, and/or browsing behavior. In the past twelve months, we have provided the following categories of information to advertising partners; data analytics providers; and tag management systems in ways that could be considered a “sale” under California law:

• Personal identifiers, such as unique personal identifier, online identifier, internet protocol address, device information and identifiers, and unique advertising identifiers and cookies; Internet and other electronic network activity information; geolocation information; inference data; and commercial information.

We disclosed these categories of information to these third parties in order to market and advertise our products and services; perform analytics; and to maintain, improve, upgrade, or enhance our products or services.

California residents have the right to opt out of the “sale” of their personal information. Right of Access and Deletion

• Right of Access. You have the right to access your personal information maintained by us. Upon receipt of a verifiable request to access personal information, we will disclose and deliver, free of charge, the personal information requested. Please note that we are not required to provide personal information to you more than twice in a 12-month period.
• Right of Deletion. You have the right to request that we delete any personal information about you which we have collected from you. Upon receipt of a verifiable request for deletion, and except as otherwise provided below or required by applicable law, we will delete your personal information from our records and direct any service providers to delete your personal information from our records, within 45 days.

We will comply with your request to delete personal information unless it is necessary for us to maintain your personal information in order to:

• Complete a transaction, provide requested-for goods/services, and/or perform a contract between you and us;
• Detect security incidents;
• Comply with a legal obligation;
• Enable our internal uses that are aligned with your expectations and your relationship with us.

Exercising Your Rights

We have designated the following methods for California residents to submit requests for information:

After you submit a request, we will promptly take steps to determine whether your request is a verifiable request. We will verify that you are who you say you are.

We will disclose and deliver the required information to you free of charge within 45 days of receiving your verifiable request. If necessary, we will extend the time period to provide the required information once by an additional 45 days, and will provide you with notice of the extension within the first 45-day period. The disclosure shall cover the 12-month period preceding our receipt of the verifiable request.

If you have requested deletion of your Personal Information, we will ask you to confirm whether you would like to delete all Personal Information that we maintain, or just certain specific pieces of Personal Information. We will honor your request, unless an exception applies. We will confirm with you when your Personal Information has been deleted, or provide you with the reason that we are unable to honor your request.

We do not knowingly collect information from or about children, including children younger than 18 years of age. We do not sell information of minors under 18 years of age.

You have the right to designate an authorized agent to submit an access or deletion request on your behalf. If you use an authorized agent to submit such a request, we will require that you:

• Provide the authorized agent written permission to act on your behalf; and
• Verify your own identity with us before we can honor the request.

Non-Discrimination

We will not discriminate against a California resident because the California resident exercised any of the rights described here. Unless permitted by the CCPA, we will not:

• Deny you goods or services.
• Charge you different prices or rates for goods or services, including through granting discounts or other benefits.
• Provide you a different level or quality of goods or services.
• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
• Retaliate against an employee, applicant for employment, or independent contractor.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your Personal Information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

California Shine the Light Act

In accordance with California Civil Code Section 1798 (California Shine the Light Act), California residents who have an established business relationship with us may request information once a year about the sharing of their Personal Data with third parties for those third parties’ direct marketing purposes.

If you wish to request more information under California’s Shine the Light law and are a California resident, you may contact us using any of the methods described in the Contact Information section.

12. Choice/Opt-Out

Subject to advance consent where required by law, we may send you communications or data regarding our Services and those of our partners in various formats, including email and/or text. These communications may include, but are not limited to: (i) notices about your use of our Services, including any notices concerning violations of use; (ii) updates; (iii) promotional information and materials regarding our Services; and (iv) transaction/order information. You may opt-out of receiving promotional communications from Client by following the opt-out instructions provided in those emails/texts. You may also opt-out of receiving promotional emails and other promotional communications from us at any time by emailing legal@tires-easy-truck.com with your specific request. Opt-out requests will not apply to transactional service messages, such as security alerts and notices about your current account and Services.

13. Third Party Links

We may provide you with links to third party websites so that you can browse those sites for items that may be of interest. We are not responsible for the collection, use, or sharing of your personal information if you visit one of these third-party websites. Please consult each linked website’s privacy policy for a description of how the website collects, uses, and shares your personal information.

14. International Visitors

We are located in the United States. If you are not a resident of the United States, your country’s laws governing data collection and use may differ from those in the United States; in particular, the United States may not provide the same level of protections as those in your own country. By using the Services or providing your personal information to us, you are transferring your information to the United States, and you consent to the transfer, retention, and processing of such data in the United States.
